Welcome to TradeLookup. These Terms of Service ("Terms") govern your access to and use of the website located at https://tradelookup.ai, our mobile application ("App"), and all related services (collectively, the "Services") operated by Hennster Consulting LLC doing business as TradeLookup ("TradeLookup," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use our Services.

1. ELIGIBILITY AND ACCOUNT REGISTRATION

 In Short: You must be at least 18 years old to use TradeLookup. You are responsible for your account.

You must be at least 18 years of age to use our Services. By using TradeLookup, you represent and warrant that you are 18 or older, have the legal capacity to enter into a binding agreement, and are not prohibited from using the Services under applicable law.

Certain features require account registration. You agree to:
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the confidentiality of your password and account
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately at hello@tradelookup.ai of any unauthorized use of your account

2. DESCRIPTION OF SERVICES

 In Short: TradeLookup is an AI-powered home repair diagnosis and contractor matching platform.

TradeLookup provides a digital platform that allows:
  • Homeowners to upload photos of home repair problems and receive AI-generated diagnoses, cost estimates, DIY guides, and connections to local contractors and suppliers
  • Contractors to create paid listing profiles to receive leads from homeowners in their service area
  • Suppliers to create paid listing profiles to reach DIY homeowners and contractors

TradeLookup is a technology platform only. We do not perform home repairs, employ contractors, or provide construction services of any kind. We are not a licensed contractor, general contractor, or home improvement company in any jurisdiction.

3. AI-POWERED DIAGNOSIS — IMPORTANT LIMITATIONS

 In Short: AI diagnoses are estimates only — not professional inspections. Always consult a licensed professional before making repair decisions.

TradeLookup uses Anthropic's Claude AI to analyze photos and provide repair diagnoses, severity assessments, cost estimates, and DIY guidance. YOU UNDERSTAND AND AGREE THAT:
  • AI diagnoses are estimates only and do not constitute professional engineering, structural, or contractor assessments
  • AI-generated cost estimates may be inaccurate and vary significantly based on location, materials, labor market conditions, and actual scope of work
  • AI diagnoses should not be used as the sole basis for making repair decisions, especially for structural, electrical, plumbing, or safety-related issues
  • Photos submitted for diagnosis are processed by Anthropic's API and are subject to Anthropic's Privacy Policy
  • TradeLookup is not liable for any damages, injuries, or losses resulting from reliance on AI-generated diagnoses or estimates
  • You should always obtain multiple in-person quotes from licensed professionals before beginning any home repair work

DIY repair guides and safety tips provided by TradeLookup are for general informational purposes only. Attempting repairs without proper skills, tools, or permits may be dangerous and may void insurance or warranties. TradeLookup is not responsible for injuries, property damage, or code violations resulting from DIY repair attempts.

4. CONTRACTOR AND SUPPLIER LISTINGS

 In Short: TradeLookup does not employ, endorse, or guarantee any contractor or supplier. Always verify independently.

Contractors and suppliers listed on TradeLookup are independent businesses, not employees, agents, or representatives of TradeLookup. TradeLookup does not:
  • Conduct background checks on listed contractors or suppliers
  • Verify contractor licenses, insurance, bonding, or certifications
  • Guarantee the quality, timeliness, or legality of contractor work
  • Verify the authenticity of user-submitted reviews or ratings
  • Mediate disputes between homeowners and contractors

Users are solely responsible for:
  • Verifying contractor licenses, insurance, and credentials with the appropriate state licensing boards
  • Obtaining written contracts, detailed scopes of work, and itemized estimates
  • Checking references and reviews from multiple independent sources
  • Ensuring compliance with local building codes, permit requirements, and regulations
  • All disputes, claims, or issues arising from contractor or supplier relationships

TradeLookup reserves the right to remove any contractor or supplier listing at any time for any reason, including but not limited to complaints, suspected fraud, non-payment of subscription fees, or violation of these Terms.

Contractor Responsibilities. Contractors and suppliers who create listings on TradeLookup represent and warrant that all information provided is accurate, that they hold all required licenses and insurance for their jurisdiction, and that they will provide services in a professional and lawful manner.

5. SUBSCRIPTIONS, BILLING, AND PAYMENTS

 In Short: Subscriptions are billed monthly or annually via Stripe. Cancellations take effect at the end of the billing period.

TradeLookup offers paid subscription plans for contractors, suppliers, and homeowners. Current pricing is displayed on the platform and may be updated from time to time.

Billing. All payments are processed by Stripe, Inc. By subscribing, you authorize TradeLookup to charge your payment method on a recurring basis (monthly or annually depending on your selected plan). You agree to Stripe's Terms of Service.

Cancellation. You may cancel your subscription at any time from your account dashboard or by contacting hello@tradelookup.ai. Cancellations take effect at the end of the current billing period. You will retain access to paid features until that date.

Refunds. All subscription fees are non-refundable except where required by applicable law or at TradeLookup's sole discretion. If you believe you were charged in error, contact us within 14 days of the charge at hello@tradelookup.ai.

Price Changes. TradeLookup reserves the right to change subscription pricing with at least 30 days' advance notice to active subscribers. Your continued use of the subscription after the price change constitutes acceptance of the new pricing.

Failed Payments. If a payment fails, we may suspend or terminate your subscription and access to paid features until the outstanding balance is resolved.

6. AFFILIATE LINKS AND THIRD-PARTY PRODUCTS

 In Short: TradeLookup earns commissions from affiliate links. We don't endorse or guarantee third-party products.

TradeLookup participates in affiliate marketing programs, including but not limited to Amazon Associates, The Home Depot Affiliate Program, and Lowe's Affiliate Program. When you click on product links in our DIY Kit, Tools Needed, or Materials Needed sections, we may earn a commission on qualifying purchases at no additional cost to you.

Affiliate links and product recommendations are provided for convenience only. TradeLookup does not endorse, guarantee, or take responsibility for any third-party products, their quality, safety, or suitability for any particular repair. Purchase decisions are solely your responsibility.

TradeLookup may also display sponsored or native advertising content from third parties. Sponsored content is clearly labeled. TradeLookup does not make warranties regarding the accuracy of advertising claims made by sponsors.

7. USER CONDUCT AND PROHIBITED USES

 In Short: Use TradeLookup lawfully and honestly. Misuse may result in account termination.

You agree not to use TradeLookup to:
  • Submit false, misleading, or fraudulent information, reviews, or contractor profiles
  • Impersonate any person, contractor, or business
  • Upload photos or content you do not own or have rights to use
  • Scrape, crawl, or harvest data from the platform without written consent
  • Circumvent rate limits, access controls, or security features
  • Use the platform for any illegal purpose or in violation of any applicable laws
  • Post spam, unsolicited commercial messages, or promotional content in reviews
  • Interfere with the proper functioning of the platform or servers
  • Attempt to reverse-engineer, copy, or reproduce any portion of the platform

TradeLookup reserves the right to remove any content, suspend, or permanently terminate any account that violates these rules at our sole discretion without prior notice or liability.

8. INTELLECTUAL PROPERTY

 In Short: TradeLookup and its content are our property. You keep ownership of content you submit.

The TradeLookup name, logo, brand, platform design, software, code, text, graphics, and all other content created by TradeLookup ("TradeLookup Content") are owned by or licensed to Hennster Consulting LLC and are protected by copyright, trademark, and other intellectual property laws. TradeLookup™ is a trademark of Hennster Consulting LLC. All rights reserved.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any TradeLookup Content without our prior written permission.

User Content. You retain ownership of photos, reviews, and other content you submit to TradeLookup ("User Content"). By submitting User Content, you grant TradeLookup a non-exclusive, royalty-free, worldwide license to use, display, and reproduce your User Content solely for the purpose of operating and improving the platform. You represent that you own or have the rights to all User Content you submit.

9. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

TRADELOOKUP DOES NOT WARRANT THAT:
  • THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • AI DIAGNOSES, COST ESTIMATES, OR REPAIR RECOMMENDATIONS WILL BE ACCURATE OR COMPLETE
  • CONTRACTOR OR SUPPLIER INFORMATION IS CURRENT, ACCURATE, OR VERIFIED
  • ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED
  • THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADELOOKUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
  • Property damage or personal injury resulting from contractor work or DIY repairs
  • Losses arising from reliance on AI diagnoses, cost estimates, or repair guidance
  • Any contractor's failure to perform, breach of contract, fraud, or negligence
  • Loss of profits, data, goodwill, or business opportunities
  • Unauthorized access to your account or personal information
  • Service interruptions, bugs, or platform errors
  • Disputes between users and contractors or suppliers

IN NO EVENT SHALL TRADELOOKUP'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO TRADELOOKUP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, TRADELOOKUP'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless TradeLookup, Hennster Consulting LLC, and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
  • Your use of the Services in violation of these Terms
  • Your User Content or information you submit to the platform
  • Any contractor work, transactions, or disputes between you and a contractor or supplier
  • Your violation of any applicable law or third-party rights

12. GOVERNING LAW AND DISPUTE RESOLUTION

 In Short: Texas law governs these Terms. Disputes will be resolved by binding arbitration in Tarrant County, Texas.

Governing Law. These Terms and any disputes arising out of or related to them shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions.

Informal Resolution. Before filing any formal legal claim, you agree to first contact TradeLookup at hello@tradelookup.ai and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Tarrant County, Texas. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LITIGATION.

Small Claims. Notwithstanding the above, either party may bring an individual claim in small claims court for disputes within that court's jurisdiction.

13. CHANGES TO THESE TERMS

TradeLookup reserves the right to modify these Terms at any time. If we make material changes, we will provide at least 30 days' notice by posting a notice on the platform or by emailing registered users. The updated Terms will be indicated by a revised "Last updated" date at the top of this page.

By continuing to use the Services after the effective date of any changes, you agree to be bound by the revised Terms. If you do not agree, you must stop using the Services.

14. TERMINATION

TradeLookup may suspend or terminate your access to the Services at any time, with or without notice, for any reason including but not limited to violation of these Terms, non-payment, or fraudulent activity.

You may terminate your account at any time by contacting hello@tradelookup.ai. Termination does not entitle you to a refund of any prepaid subscription fees.

Upon termination, Sections 8 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), and 12 (Governing Law) shall survive and remain in full force and effect.

15. MISCELLANEOUS

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TradeLookup regarding your use of the Services and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. TradeLookup's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. TradeLookup may assign its rights and obligations without restriction.

Force Majeure. TradeLookup shall not be liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, internet outages, or government actions.
